ACTION: Proposed Rule
SYNOPSIS: NASA is proposing to amend the NFS to add a contract clause requiring contractors with contracts exceeding $5,000,000 and performed at contractor facilities in the United States to display NASA Inspector General Hotline posters.
EDITOR'S NOTE: On May 4, 2000, the Environmental Protection Agency (EPA) proposed a similar contract clause for the EPA Acquisition Regulation (EPAAR). SUPPLEMENTAL INFORMATION: NASA's Office of Inspector General (IG) has requested that NASA contractors be required to display "hotline posters" in domestic facilities where work on NASA contracts exceeding $5 million is being performed.
This proposed rule would add NFS Subpart 1803.70, IG Hotline Posters. NFS Subpart 1803.70 would consist of NFS 1803.7000, Policy ("NASA requires contractors to display NASA hotline posters...so that employees of the contractor having knowledge of waste, fraud, or abuse, can readily identify a means to contact NASA's IG"), and NFS 1803.7001, Contract Clause, which would require the inclusion of NFS 1852.203-70, Display of Inspector General Hotline Posters, in solicitations and contracts expected to exceed $5,000,000 and performed at contractor facilities in the United States.
New NFS 1852.203-70 would require covered contractors to "display prominently in common work areas...Inspector General Hotline Posters... [which] may be obtained from NASA Office of Inspector General, Code W, Washington, DC, 20546-0001, (202) 358-1220."
EDITOR'S NOTE: The introductory material to this proposed rule contains the following statement: "By waiver from [Federal Acquisition Regulation] Part 12, NASA might also impose this requirement on a case-by-case basis in contracts for commercial items when unusual circumstances warrant. An example of such circumstances might include procurements involving extraordinary concerns about the safety of human life."
