ACTION: Final Rule

SYNOPSIS: NASA is amending the NFS so that it conforms to the FAR as changed by Federal Acquisition Circulars (FACs) 97-20, 97-22, and 97-26, and to make editorial and miscellaneous changes dealing with NASA internal and administrative matters.

SUPPLEMENTAL INFORMATION: FAC 97-20 amended various FAR subparts and clauses to implement the Veterans Entrepreneurship and Small Business Development Act of 1999 (Public Law 106-50), which established new assistance programs for veterans and service-disabled veterans who own and operate small businesses.

FAC 97-22, Item 3, amended FAR Subpart 32.4, Advance Payments for Non-Commercial Items, to change certain terminology (for example, change the word "bank" to "financial institution"), and Item 6 updated references in FAR Subpart 42.2, Contract Administration Services, to the Defense Contract Management Agency.

FAC 97-26 designated Federal Business Opportunities (http://www.FedBizOpps.gov) as the "governmentwide point of entry" (GPE) -- the single point of universal electronic public access to governmentwide procurement opportunities.

This final rule makes changes to the NFS to conform it to the FAR as changed by FAC 97-20 (NFS 1819.201, General Policies); FAC 97-22, Item 3 and Item 6 (NFS 1815.404-2, Information to Support Proposal Analysis; NFS 1832.410, Findings, Determination, and Authorization; NFS 1842.302, Contract Administration Functions; NFS 1844.302-70, DCMA-Conducted Contractor Purchasing System Reviews; NFS 1844.302-71, NASA-Conducted Contractor Purchasing System Reviews); and FAC 97-26 (NFS 1804.570-1, General; NFS 1804.570-2, Electronic Posting System).
