SYNOPSIS: On February 17, 2001, President Bush issued Executive Order 13204, which revoked Executive Order 12933 of October 20, 1994, Nondisplacement of Qualified Workers Under Certain Contracts; directed the Secretary of Labor to rescind the regulations and policies implementing Executive Order 12933; and ordered the termination of all investigations or other compliance actions based on Executive Order 12933. In compliance with Executive Order 13204, DOL is issuing a final rule rescinding the regulations implementing Executive Order 12933.

SUPPLEMENTAL INFORMATION: Executive Order 12933 provided that workers on a building service contract for a public building be given the right of first refusal for employment with a successor contractor if they would otherwise lose their jobs as a result of termination of the contract. The implementing regulations were in Title 29 of the Code of Federal Regulations, Part 9. With the signing of Executive Order 13204 rescinding Executive Order 12933, the authority for these regulations no longer exists, so 29 CFR Part 9 is removed. The rescission of these regulations extend to all investigations or other compliance actions based on Executive Order 12933.
