DATE: June 1, 2001
SUBJECT: National Aeronautics and Space Administration Federal Acquisition Regulation (FAR) Supplement (NFS); Extension of Class Deviations for Small Business Innovation Research (SBIR) Contracts
SOURCE: Federal Register, June 1, 2001, Vol. 66, No. 106, page 29728
AGENCIES: National Aeronautics and Space Administration (NASA)
ACTION: Final Rule
SYNOPSIS: NASA is amending paragraph (e)(1)(B)(a) of NFS 1832.402, General, and paragraph (e) of NFS 1832.702-70, NASA Policy, to extend NASA's advance payments and incremental funding class deviations for SBIR program contracts.
EDITOR'S NOTE: For more on the SBIR program, which is administered by the Small Business Administration (SBA), see the May 18, 2001, FEDERAL CONTRACTS DISPATCH "Small Business Administration; Small Business Innovation Research Program."
EFFECTIVE DATE: June 1, 2001.
FOR FURTHER INFORMATION CONTACT: Mr. Ronald Lentz, NASA Headquarters, Office of Procurement, Contract Management Division (Code HK), Washington, DC 20546, 202-358-1064, e-mail: email@example.com.
SUPPLEMENTAL INFORMATION: NFS 1832.402(e)(1)(B)(a) states that a class deviation authorizing the use of advance payments for Phase I contracts awarded under the SBIR program is in effect through September 30, 2000. NFS 1832.702-70(e) states that a class deviation permitting the use of incremental funding for Phase II contracts awarded under the SBIR program is in effect through September 30, 2000. The September 30, 2000, expiration date was the date established in the Congressional authorization for the SBIR program. However, the Small Business Innovation Research Program Reauthorization Act of 2000 (Public Law 106-554) extended the SBIR program through September 30, 2008. This final rule removes the September 30, 2000, expiration date from NFS 1832.402(e)(1)(B)(a) and NFS 1832.702-70(e), thus extending the advance payments and incremental funding class deviations for the life of the SBIR program.
