SYNOPSIS: DOD is finalizing, with minor changes, an interim rule that amended DFARS Subpart 219.8, Contracting with the Small Business Administration (The 8(a) Program), to implement a partnership agreement (PA) between DOD and the Small Business Administration (SBA) to streamline procedures for contract awards under SBA's 8(a) Program.

SUPPLEMENTAL INFORMATION: A PA between DOD and SBA, dated February 1, 2002, permits DOD to award 8(a) contracts directly to 8(a) concerns on behalf of SBA. An interim rule was published on March 14, 2002, to implement the PA by amending DFARS Subpart 219.8. One comment was received on the interim rule, and it supported the rule. Therefore, the interim rule is being finalized with one minor editorial change: the word "must" is changed to "shall" in paragraphs (1), (1)(ii)(A), (2), (2)(i), and (3) of DFARS 219.804-2, Agency Offering; paragraphs (1) and (2) of DFARS 219.806, Pricing the 8(a) Contract; paragraph (a) of DFARS 219.811-1, Sole Source; and DFARS 219.811-2, Competitive.
