SUBJECT: Defense Federal Acquisition Regulation Supplement (DFARS); Partnership Agreement Between DOD and the Small Business Administration

ACTION: Interim Rule

SYNOPSIS: DOD is amending DFARS Subpart 219.8, Contracting with the Small Business Administration (The 8(a) Program), to implement a partnership agreement (PA) between DOD and the Small Business Administration (SBA) to streamline procedures for contract awards under SBA's 8(a) Program.

DATES: The effective date of this interim rule is March 14, 2002. Comments on the interim rule must be submitted on or before May 13, 2002.

SUPPLEMENTAL INFORMATION: A PA between DOD and SBA, dated February 1, 2002, permits DOD to award 8(a) contracts directly to 8(a) concerns on behalf of SBA. The PA replaces a memorandum of understanding (MOU) which also permitted DOD to award 8(a) contracts, and was implemented in DFARS Subpart 219.8. This interim rule amends DFARS Subpart 219.8 to reflect the provisions of the new PA. (EDITOR'S NOTE: The MOU was executed May 6, 1998, and was to expire May 65, 2001, but it was extended to December 31, 2001 -- see the October 1, 2001, FEDERAL CONTRACTS DISPATCH "Defense Federal Acquisition Regulation Supplement (DFARS); Memorandum of Understanding on the Section 8(a) Program.")

Besides changing "MOU" to "PA" wherever it appears in DFARS Subpart 219.8 and DFARS 252.219-7009, Section 8(a) Direct Award, this interim rule makes the following significant changes:
