SYNOPSIS: DOD is amending DFARS 225.7020-4, Contract Clause, to clarify that the statutory restriction on acquisition of vessel propellers from foreign sources applies only to contracts that use fiscal year 2000 or 2001 funds.

SUPPLEMENTAL INFORMATION: The restriction on the acquisition of vessel propellers at DFARS 225.7020, Restrictions on Vessel Propellers, implements Section 8064 of the DoD Appropriations Act for Fiscal Year 2001 (Public Law 106-259), which provides that no funds appropriated in fiscal year 2000 or 2001 may be used for the procurement of vessel propellers other than those produced by a domestic source and are of domestic origin. The restriction is implemented in DFARS 252.225-7023, Restriction on Acquisition of Vessel Propellers. However, the DOD Appropriations Act for Fiscal Year 2002 (Public Law 107-117) contains no such provision. Therefore, this final rule amends DFARS 225.7020-4 to clarify that DFARS 252.225-7023 is to be used only in solicitations and contracts that use fiscal year 2000 or 2001 funds.
