ACTION: Final Rule

SYNOPSIS: NASA is amending Alternate I of NFS 1852.245-71, Installation -- Accountable Government Property, to resolve conflicting direction regarding the delivery of property. Also, NASA is amending the NFS to change all references to "NASA Procedures and Guidelines" (NPGs) to "NASA Procedural Requirements" (NPRs).

SUPPLEMENTAL INFORMATION: NFS 1852.245-71 is included in contracts "when government property is to be made available to a contractor working on a NASA installation, and the government will maintain accountability for the property. Paragraph (b)(1)(i) of NFS 1852.245-71 requires that "the contractor's purchase order shall require the vendor to deliver the property to the installation central receiving area..."

Alternate I of NFS 1852.245-71 is included in contracts if the supply and equipment management officer (SEMO) "requests that the contractor be restricted from use of the center central receiving facilities for the purposes of receiving contractor-acquired property." However, Alternate I requires that this prohibition be added to NFS 1852.245-71 as paragraph (b)(3), thus contradicting the direction in NFS 1852.245-71(b)(1)(i). The original intent was for Alternate I to be substituted for direction in the basic clause, not added. Therefore, the prescription for Alternate I is revised to require the contracting officer to substitute the language for paragraph (b)(1)(i) instead of adding it as paragraph (b)(3).

Also, "NASA Procedures and Guidelines" (NPGs) have been redesignated as "NASA Procedural Requirements" (NPRs). This final rule changes all references to NPGs in the NFS to NPRs to reflect this change.
